Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and software products operated by Kinetic Helix LLC(“Kinetic Helix,” “we,” “us,” or “our”), including Mail Falcon, Attendance Tracker, and our other products (collectively, the “Services”). By creating an account, subscribing, or using the Services, you agree to these Terms.

1. Who we are

Kinetic Helix LLC is a product engineering studio that designs, builds, and operates its own software products. Kinetic Helix is the provider and merchant of record for paid subscriptions to those products, and charges appear on your statement under Kinetic Helix. 2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the activity under your account and for keeping your credentials secure. Provide accurate information and keep it up to date.

3. Subscriptions, billing & renewals

• Paid plans are billed on a recurring basis (monthly unless stated otherwise) through our payment processor, Stripe. Current prices are listed on our Pricing page and within each product.
• Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. By subscribing, you authorize us to charge your payment method for each renewal.
• Prices are exclusive of taxes unless stated; you are responsible for any applicable taxes.
• We may change prices with reasonable notice; changes apply to the next billing period.

4. Cancellation & refunds

You can cancel at any time from your account or by contacting us. Your plan stays active through the end of the period you have already paid for, and you will not be charged again. Please review our Refund & Cancellation Policy for full details.

5. Acceptable use

You agree not to misuse the Services. You will not:

• break the law or infringe others’ rights;
• send spam or unsolicited messages, or use the Services to harass or deceive;
• attempt to gain unauthorized access, disrupt, or reverse-engineer the Services;
• resell or provide the Services to third parties except as expressly permitted.

6. Your content & data

You retain ownership of the content and data you submit. You grant us a limited license to host and process it solely to provide and improve the Services. Our handling of personal data is described in our Privacy Policy.

7. Intellectual property

The Services, including software, design, and trademarks, are owned by Kinetic Helix and protected by law. These Terms do not grant you any right to our trademarks or branding.

8. Third-party services

The Services integrate with third-party platforms (for example, Google Workspace, Gmail, and Stripe). Your use of those platforms is governed by their own terms, and we are not responsible for them.

9. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or meet your specific requirements.

10. Limitation of liability

To the maximum extent permitted by law, Kinetic Helix will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to the Services is limited to the amount you paid us for the Service in the twelve months before the claim.

11. Termination

You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or to protect the Services. On termination, your right to use the Services ends; sections that by their nature should survive will survive.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Continued use after changes take effect means you accept the updated Terms.

13. Governing law & contact
